The Constitution of the United States of America

The Bill of Rights
(Article IX) The enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the people.

(Article XIV) Section 1. All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside. No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws.

We’re all familiar with what a “virus” can do to a computer. It can eat up the hard disk, attach itself to outgoing emails, slow down internet commerce—in effect it can ruin anything and everything within the system that it touches.

The Constitution (and the first ten amendments, "the Bill of Rights") is one of the most enlightened and revered documents any government in the world has ever created. And we don’t like having it messed with. Yet there are segments of this country who are ready to introduce a virus into that document that would abridge the most sacred notions that all men are created equal and that the Constitution protects individual freedom. (Even politically incorrect people recognize that this includes women, but I feel it is necessary to say it here to avoid any confusion or consternation.)

Amendment Nine of the first ten amendments to the US Constitution (the Bill of Rights) says: “The enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the people.” But to adopt an amendment in the Constitution how ever stated—either that marriage is between only one man and one woman, or that two members of the same sex cannot be married—is to directly counter the intent of Amendment Nine in the Bill of Rights.

Amendment Fourteen reinforces Nine and goes even further: Section 1. All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside. No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws.

Further, such an amendment goes against the Declaration of Independence: “We hold these Truths to be self-evident, that all Men are created equal, that they are endowed by their Creator with certain unalienable Rights, that among these are Life, Liberty and the Pursuit of Happiness.”

Amending the Constitution to deny rights to a whole segment of society would only be the beginning of an assault on these unalienable rights.

People who love liberty and individual rights over all other considerations recognize the destructive nature that an amendment to deny any rights to any citizen would have on our most basic and trusted foundation.

Amendment Nine is so simple in language and construction that only the most cynical politician would seek to leverage it in such a way as to allow an amendment to abridge its intent. In fact, we feel so strongly about our freedoms in this republic that our supreme court can overturn any law from any state that violates our Constitution, so that states as self-governing entities must also comply with federal constitutional intent. No state's constitution has precedence.

In the coming months be diligent and watchful as Amendment Nine gets dusted off and deliberated. The only way to protect our most basic unalienable rights is to create a firewall of resistance to such an amendment: oust any politician state or federal from either political party who has ever suggested he or she would support a constitutional amendment to ban gay marriage (or to support marriage as only between one man and one woman). Even the Log Cabin Republicans have broken with the Supreme-Court-Appointed President Bush on this issue.
